This Acceptable Use Policy (AUP) sets forth the rules and guidelines for using Mailaway ("Service"). By using Mailaway, you agree to comply with this policy. Violations may result in suspension or termination of your account.
1. General Principles
Mailaway is designed to help creators and businesses send compliant, ethical, and legal email marketing campaigns. You must not use Mailaway for any illegal, abusive, harmful, deceptive, or prohibited activities as listed below.
2. Prohibited Uses
2.1. Illegal, Harmful, or Deceptive Activities
You may not use Mailaway to create, send, display, market, advertise, or sell content, services, or products related to:
- Illegal goods or services
- Terrorism or political extremism
- Escorts, prostitution, or adult companionship services
- Mail-order bride/spouse finder services and international marriage brokers
- Gambling, betting, or casino-related services
- Pornography, adult entertainment, adult novelties, or hookup sites/services
- Cryptocurrencies, Initial Coin Offerings (ICOs), or other digital assets
- Day trading, foreign exchange (forex), or high-risk financial schemes
- Pharmaceuticals, unapproved supplements, or controlled substances
- Work-from-home scams, pyramid schemes, or multi-level marketing (MLM)
- Credit repair, get-out-of-debt services, or deceptive financial services
Mailaway reserves the right to determine whether a specific use case falls under these prohibited categories.
2.2. Spam & Unauthorized Email Lists
- You may not upload or send emails to any list that is purchased, rented, scraped from a third party, or compiled without explicit user consent.
- All recipients must have opted in to receive marketing emails from you.
- You must comply with CAN-SPAM, GDPR, CCPA, and other applicable email marketing laws.
- All emails must include a valid unsubscribe option, and opt-out requests must be honored immediately.
Violations will result in immediate account suspension or termination.
2.3. Unauthorized Data Collection & Scraping
- You may not systematically retrieve data or content from Mailaway to create or compile, directly or indirectly, a collection, compilation, database, or directory without our explicit permission.
- You may not engage in web scraping, harvesting, or automated data extraction from Mailaway’s site or services.
2.4. Security Violations & Unauthorized Access
You may not:
- Trick, defraud, or mislead Mailaway or other users, especially in attempts to access sensitive account information such as user passwords.
- Circumvent, disable, or interfere with security-related features, including those that prevent unauthorized copying, restrict access, or enforce limitations.
- Use information obtained from Mailaway to harass, abuse, or harm others.
- Make improper use of Mailaway’s support services or submit false reports of abuse, fraud, or misconduct.
- Attempt to bypass security measures designed to restrict or prevent access to certain features, services, or user accounts.
Mailaway actively monitors security violations and reserves the right to report unlawful activities to relevant authorities.
2.5. Malicious Activities & System Interference
You may not:
- Upload or transmit viruses, Trojan horses, worms, or malicious code that could harm Mailaway or its users.
- Engage in excessive spamming, use of capital letters, or continuous posting of repetitive text to disrupt normal operations.
- Engage in automated use of the system, such as using scripts to send comments, messages, or perform repeated automated actions.
- Use bots, spiders, crawlers, or automated tools to mine or extract data from Mailaway.
- Interfere with, disrupt, or place undue burden on Mailaway’s network, servers, or infrastructure.
Violators will be immediately banned and may be subject to legal action.
2.6. Intellectual Property Violations & Impersonation
You may not:
- Disparage, tarnish, or harm Mailaway’s reputation in any manner.
- Delete or alter copyright, trademark, or proprietary rights notices from Mailaway’s content.
- Impersonate another user or person, or misrepresent your affiliation with an entity.
- Attempt to reverse-engineer, decompile, or disassemble Mailaway’s software or services.
- Engage in unauthorized framing or linking to Mailaway’s website.
Mailaway reserves the right to take legal action against intellectual property violations.
2.7. Harassment, Abuse, and Misuse of Services
You may not:
- Harass, annoy, intimidate, or threaten Mailaway employees, contractors, or agents engaged in providing customer support or services.
- Engage in any behavior that creates a hostile or unsafe environment for Mailaway staff or users.
If you harass or abuse our team, we reserve the right to terminate your account immediately.
2.8. Unauthorized Commercial & Automated Use
- You may not make unauthorized use of Mailaway, including collecting usernames, emails, or contact details for unsolicited emails, spam, or automated messaging.
- You may not use Mailaway to create fake accounts, automate signups, or engage in fraudulent activities.
- Except as permitted by law, you may not copy, adapt, or modify Mailaway’s software, HTML, JavaScript, or source code.
- Except for standard search engines and internet browsers, you may not launch, develop, or distribute unauthorized scripts, bots, scrapers, or automation tools.
3. Compliance With Laws and Regulations
All users must comply with:
- General Data Protection Regulation (GDPR) – EU
- California Consumer Privacy Act (CCPA) – USA
- CAN-SPAM Act – USA
- Other applicable international, federal, and local laws
If you process personal data of EU residents, you may be required to enter into a Data Processing Agreement (DPA) with us.
4. Monitoring & Enforcement
Mailaway actively monitors compliance using automated and manual review systems. If violations are detected:
- First Warning: The user will receive a written notice to correct the issue.
- Temporary Suspension: If unresolved, the account may be disabled until compliance is met.
- Permanent Ban: Repeated or severe violations will result in account termination, and Mailaway reserves the right to report unlawful activities.

6. Changes to This Policy
Mailaway reserves the right to modify this Acceptable Use Policy (AUP) at any time. Changes will be posted on this page, and continued use of the Service implies acceptance of the updated terms.
